Keadilan Milik Bersama, Bukan Hanya Milik Penguasa
Kata keadilan sudah tidak asing di telinga saya. Karena sejak bersekolah di bangku SD, saya sudah mendapatkan mata pelajaran PPKN yang didalamnya banyak diajarkan mengenai teori keadilan. Waktu itu saya memahami keadilan sebagai sesuatu, baik hak maupun kewajiban yang dimiliki oleh semua warga negara dalam porsi yang sama, dalam semua aspek kehidupan.
Namun sekarang apa yang saya pahami mengenai keadilan sudah bergeser dari pemikiran saya sewaktu kecil dari teori-teori yang sudah saya dapatkan. Saya mendapati banyak keadilan yang tidak adil. Maksud saya adalah ternyata keadilan masih bisa hanya dkuasai oleh seseorang atau golongan yang memiliki kekuasaan saja. Masyarakat yang tidak memiliki kekuasaan terkadang tidak mendapatkan keadilan yang seharusnya menjadi milik mereka.
Bisa saya sebutkan disini kasus pencurian sebuah semangka, tiga biji buah cokelat, selembar celana dalam dan yang paling marak dibicarakan sekarang yaitu kasus pencemaran nama baik yang dianggap oleh RS Omni Internasional adalah perbuatanPrita. Pelaku dalam kasus tersebut diatas didakwa hukuman pidana antara 3 bulan hingga 3 tahun penjara dan denda perdata antara ratusan ribu hingga ratusan juta rupiah. Hal ini tentu tidak sebanding dengan kasus besar seperti korupsi yang bernilai hingga triliyunan, yang pelakunya hanya dihukum ringan bahkan ada yang tidak tersentuh hukum karena memiliki kekuasaan yang bisa saja membeli keadilan. Kasus-kasus yang saya sebutkan diatas hanyalah segelintir kasus ketidakadilan dalam hukum yang menimpa saudara kita yang bukan dari kalangan menengah keatas.
Sungguh miris menyaksikan kasus pidana ringan diproses hingga ke pengadilan dan dihukum yang tidak sebanding dengan tindak pidana yang telah dilakukan. Lebih miris lagi melihat para pelaku koruptor hanya dijatuhi hukuman ringan dengan fasilitas yang “wah” di penjara, bahkan ada pelaku koruptor yang masih bisa liburan ke luar negeri.
Yang menjadi pertanyaan di benak saya saat ini, apakah keadilan hanya dimiliki oleh yang berkuasa? Apakah orang miskin yang tidak punya kekuasaan tidak berhak mendapatkan keadilan? Apakah hukuman berat hanya berlaku untuk masyarakat kelas menengah ke bawah sedangkan masyarakat kelas menengah ke atas tidak tersentuh hukum? Kapankah keadilan itu menjadi milik bersama? Pertanyaan-pertanyaan ini tidak mendapat jawaban pasti.
Saya tidak bermaksud underestimate terhadap hukum yang berlaku di negara kita. Tidak bisa dipungkiri ada juga kasus yang ditangani secara adil. Namun saya tergelitik untuk menulis dalam blog mengenai hal ini karena hampir setiap hari saya disuguhi oleh pemberitaan yang didalamnya kaum miskin yang menjadi korban. Saya sebagai masyarakat awam yang kurang mengerti masalah hukum, ingin share dengan sesama blogger yang mungkin punya pemikiran yang berbeda dengan saya.

A corporation uses two basis type of financing: equity financing and debt financing. Equity financing refers to funds that are invested by owners of the corporation. Debt financing, on the other hand, refers to funds that are borrowed from sources outside the corporation.
Equity financing (obtaining owner funds) can be exemplified by the sale of corporate stock. In this type of transaction, the corporation sells units of ownership known as shares of stock. Each share entitles the purchaser to a certain amount of ownership. For example, if someone buys 100 shares of stock from Ford Motor Company, that person has purchased 100 shares worth of Ford’s resources, materials, plants, production, and profits. The person who purchases shares of stock is known as a stockholder or shareholder.
All corporations, regardless of their size, receive their starting capital from issuing and selling shares of stock. The initial sales involve some risk on the part of the buyers because the corporation has no record of performance. If the corporation is successful, the stockholder may profit through increased valuation of the share of stock, as well as by receiving dividends. Dividendsare proportional amounts of profit usually paid quarterly to stockholders. However, if the corporation is not successful, the stockholder may take a severe loss on the initial stock investment.
Often equity financing does not provide the corporation with enough capital and it must turn to debt financing, or borrowing funds. One example of debt financing is the sale of corporate bonds. In this type of agreement, the corporation borrows money from an investor in return for a bond. The bond has a maturity date, a deadline when the corporation must repay all of the money it has borrowed. The corporation must also make periodic interest payments to the bondholder during the time the money is borrowed. If these obligations are not met, the corporation can be forced to sell its assets in order to make payments to the bondholders.
All business need financial support. Equity financing (as in the sale of stock) and debt financing (as in the sale of bonds) provide important means by which a corporation may obtain its capital.
